Road Traffic Act 1988, Harassment, Alarm, Distress

Sect 59 of the Police Reform Act 2002 makes it an offence for a motor vehicle to be used on a road in a manner which causes harassment alarm or distress. Since most of the places on common or wasteland where motorcycles and quads are driven illegally are places where people go to walk recreationally on footpaths it is nearly always the case that those persons are caused some degree of distress or harassment. In such cases Police have the power to warn the user to remove the machine or risk it being seized and destroyed.

(Section 59(3)) If a person is warned, their details and the details of the bike are recorded and, if that person returns, any bike they are riding may be seized. Even if the original bike they were riding turns up with another rider on it, that too may be seized. Warwickshire Police would then apply to have the vehicle forfeited.

Warwickshire Police are committed to using this power whenever an opportunity presents itself in order to control the problem of unlawful use.
